By accessing or using Kapalabra, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.

 

Use of the Website

• Kapalabra is intended solely for personal Spanish language learning purposes.

• The use of our website for illegal, fraudulent, or third-party activities is prohibited.

• We provide educational content and tools, which may not be copied, modified, published, reproduced, distributed, or used for commercial purposes without our written permission.

• Access is personal and non-transferable, so it may not be shared or used by anyone other than the  owner.

• Failure to comply with these terms may result in the suspension of the service or access without the right to any refund or compensation.

 

Content

• Course content is tailored to each student's level and interests and is therefore for personal use only.

• The time required to achieve conversational proficiency in Spanish depends on personal effort and perseverance, so Kapalabra cannot guarantee a specific timeframe to achieve learning objectives.

• As an independent Spanish teaching institution, Kapalabra is NOT authorized to issue official certificates or certifications. However, we can issue certificates of participation and levels achieved without legal or official value, according to our internal criteria.

• Materials that are publicly available online may occasionally be included.

Payment Policy

• Payments are made in advance as defined on the booking page.

• Courses and services are quoted in USD (US dollars).

• We reserve the right to change the price of courses and/or services without prior notice.

• We reserve the right to create, modify, maintain, and/or cancel promotions and/or discounts at any time as deemed necessary.

• Access to classes will only be granted after the corresponding session package has been paid for.

• Electronic invoices will be issued individually for each class session. 

• Students are responsible for providing correct billing information at the time of payment.

Refund Policy

• Refunds are not available once a session package has been paid for.

Class Scheduling Policy

• Sessions must be scheduled within the validity period of the purchased package.

• If you need to reschedule a session, you must notify us at least 24 hours in advance. Requests made after this period may not be accepted.

• Students may reschedule a maximum of two sessions per package, depending on availability.

• A delay of up to 10 minutes will be tolerated. After this time, the session will be considered missed and will not be rescheduled.

• If a student does not attend a scheduled session without prior notice, the session will be considered completed and will not be refunded or rescheduled.

Package Validity

• Session packages must be used within the validity period specified at the time of purchase.
• Any unused sessions after the expiration of the package validity period will be considered forfeited and cannot be refunded or transferred.

Instructor Availability

• Kapalabra reserves the right to reschedule sessions in exceptional circumstances such as illness, technical issues, or unforeseen events.
• In such cases, an alternative session time will be offered.

Technical Requirements

• Students are responsible for ensuring they have a stable internet connection and the necessary equipment to participate in online sessions.
• Kapalabra is not responsible for interruptions caused by the student’s technical issues.

Account Creation

• In cases where registration is required to access certain features, we ask that you provide accurate and up-to-date information.

• It is your responsibility to maintain the confidentiality of your login credentials and to report any unauthorized use of your account.

 

Intellectual Property

• All content on the website, including text, images, graphics, and software, is the intellectual property of Kapalabra or its licensors, protected by copyright laws.

• Any unauthorized reproduction, modification, distribution, or use of the content is prohibited.

 

Privacy

Our Privacy Policy governs the processing of your personal data. By accepting these terms, you also agree to the provisions described in our Privacy Policy.

 

Limitation of Liability

• Kapalabra is not responsible for errors, technical interruptions, or loss of data that may arise during the use of the website.

• We do not guarantee specific results in learning Spanish, as your learning process depends on your dedication, perseverance, and personal effort.

 

Modifications

We reserve the right to modify these Terms and Conditions at any time. Any changes will be communicated through our website or by email.

 

Cancellation of Services

• Kapalabra reserves the right to suspend or cancel access to the website if a breach of these terms is detected.

• As a user, you may cancel your account or continue participating in the course at any time by contacting us through the channels provided.

 

Applicable Law

These Terms and Conditions are governed by the laws of Guatemala. Any dispute will be resolved in the competent courts of Guatemala.
